Terms and Conditions for LingoNavi Language Platform

Welcome to LingoNavi Language Platform ("LingoNavi”), an online platform that connects students with independent language teachers worldwide. By registering an account, enrolling in lessons, or using our services, you agree to comply with the following Terms and Conditions ("Terms”). Please read them carefully before using our platform.

1. Acceptance of Terms

By creating an account or using LingoNavi’s services, you ("Student,” "Parent,” or "User”) agree to be bound by these Terms. If you are a parent or legal guardian enrolling a minor, you also agree to be responsible for the minor’s compliance with these Terms.

2. Eligibility

2.1 Students: LingoNavi is open to learners of all ages. Users under 18 years of age must have parental or guardian consent.

2.2 Parents/Guardians: By enrolling a minor, you confirm you are the legal guardian and consent to their participation.

3. Account Registration and Payment

3.1 Registration

Users must register on lingonavi.com and provide accurate, complete information (e.g., name, age, contact information, learning goals).

3.2 Payment

Payments are processed securely through approved third-party payment processors. Lesson fees vary by teacher.

3.3 Refund Policy

Refunds may follow each teacher’s cancellation/refund policy. LingoNavi issues refunds only in verified technical or billing error cases.

3.4 Taxes and Fees

Users are responsible for any applicable taxes, processing fees, or currency conversion charges.

4. Lessons, Materials, and Access

4.1 Lesson Materials

Teacher-provided materials are for personal use only and may not be copied, recorded, shared, or distributed without permission.

4.2 Lesson Access

Users access booked lessons through their LingoNavi account. Access may be suspended for non-payment or violation of these Terms.

4.3 Platform Availability

LingoNavi aims to provide continuous service but may experience maintenance downtime or technical issues.

5. Student Responsibilities

5.1 Participation

Students must attend lessons on time, complete assigned work, and behave respectfully.

5.2 Technology Requirements

Users must have stable internet, a functioning device, and communication tools (e.g., Zoom or Google Meet).

5.3 Code of Conduct

Harassment, discrimination, bullying, inappropriate language, or harmful behavior is prohibited.

5.4 Cancellation

Cancellations must follow each teacher’s policy. Late cancellations may result in forfeited lessons.

5.5 Communication with Teachers

Students/parents must communicate with teachers only through official LingoNavi channels. Off-platform personal contact is not permitted.

5.6 Recording Lessons

Recording or distributing lesson content requires explicit permission from the teacher and LingoNavi.

6. Teacher Responsibilities

6.1 Independent Contractors

Teachers are independent providers, not employees of LingoNavi.

6.2 Professional Standards

Teachers must maintain professionalism and provide accurate information regarding their qualifications.

6.3 Disputes

LingoNavi may mediate disputes but is not obligated to resolve issues or issue refunds unless platform policies are violated.

7. Privacy, Data Protection, and Google API Compliance

7.1 Data Collection

We collect and process user data as described in our Privacy Policy. Use of the platform indicates your consent.

7.2 Data Security

We use SSL and appropriate technical safeguards, but no online system is completely secure.

7.3 Third-Party Services

To operate our platform, LingoNavi integrates with trusted third-party services, including Google OAuth, Google Calendar, and Google Analytics.

8. Compliance with Google OAuth (Google Login)

If you choose to log in using Google Login:

• We may access basic Google profile information: name, email address, and profile photo.
• We do not access Google Drive, contacts, emails, or any unrelated data.
• We do not store your Google password.
• Google OAuth data is used only for account authentication and login.
• You may revoke access at any time in your Google Account permissions.
• All use complies with the Google API Services User Data Policy, including the Limited Use Requirements, meaning:
• Data is not used for advertising.
• Data is not sold or shared with third parties.
• Data is used only to provide or improve LingoNavi functionality.
 

9. Compliance with Google Calendar API

If you choose to connect Google Calendar:

• We access your calendar only to create, modify, or delete LingoNavi-related lesson events.
• We do not access the content of unrelated events unless needed to check availability.
• We do not use Calendar data for advertising, analytics, or profiling.
• Calendar data is never shared with third parties.
• You may revoke Calendar permissions at any time through Google Account settings.
• All usage strictly adheres to the Google API Services User Data Policy and Limited Use Requirements.

10. Google Analytics Compliance

LingoNavi uses Google Analytics to improve platform performance.

Google Analytics may collect:

• IP address (may be anonymized)
• Browser/device type
• Session duration
• Page views and interaction data

We do not merge Analytics data with individual user profiles unless explicitly disclosed.
Users may opt out via:

• Google Analytics Opt-Out Add-On
• Cookie settings
• Browser Do Not Track (where supported)

Analytics usage complies with Google Analytics Terms of Service and relevant privacy laws.

11. Suspension and Termination

11.1 Violations

LingoNavi may suspend/terminate accounts for violations such as:

• Misconduct
• Non-payment
• Abuse of the platform
• Unauthorized lesson recording or redistribution

11.2 User-Initiated Closure

Users may delete accounts anytime. Refunds depend on teacher-specific policies.

12. Liability and Disclaimers

12.1 Platform Role

LingoNavi connects students with independent teachers and is not responsible for lesson quality or outcomes.

12.2 Limitation of Liability

LingoNavi is not liable for:

• Direct/indirect damages
• Data loss
• Personal injury
• Issues arising from internet connectivity, devices, or third-party tools

12.3 Force Majeure

We are not responsible for disruptions caused by events beyond our control (e.g., disasters, outages, pandemics).

13. Changes to Terms

LingoNavi may modify these Terms. Updates will appear on the website. Continued use signifies acceptance.

14. Governing Law

These Terms are governed by the laws of Japan. Disputes fall under the jurisdiction of Japanese courts.
